The following are the Terms and Conditions of use for this website, www.jdcncsolutions.com, set forth by JDCNCSolutions, Inc. By accessing this website and/or placing an order, you agree to be bound by these Terms and Conditions.

USING THIS WEBSITE INDICATES THAT YOU ACCEPT THESE TERMS REGARDLESS OF WHETHER OR NOT YOU CHOOSE TO REGISTER WITH US OR PLACE AN ORDER WITH US. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THIS WEBSITE.

You will be able to access most of the information contained on this website without needing to register your details with us. Certain areas and features, however, are for registered members only.

We may revise these Terms and Conditions at any time, without notice. You should check these Terms and Conditions periodically to review the current version. For your convenience, we have included a version number and date of last modification at the end of these Terms and Conditions. If you do not wish to accept any new and/or revised Terms and Conditions that have been posted, discontinue use of this website.

2.1	All content, graphics, designs, organization, digital media and any other matters related to and found on this website are protected under applicable copyrights, trademarks, registered trademarks and other proprietary rights, including but not limited to intellectual property.
2.2	The copying, redistribution, use or publication of any part or parts of this website is strictly prohibited without the written discretion of JDCNCSolutions, Inc.
2.3	You do NOT acquire ownership rights to any content, documents or other materials when viewed through this website. The posting of information or materials to this website does not constitute a waiver of any right in such information or materials. Once information or material is posted on this website, it becomes the property of JDCNCSolutions, Inc.

INTELLECTUAL PROPERTY

3.1	JDCNCSolutions, Inc. offers various products and information in downloadable form. Downloading such files does not grant ownership of the information contained within. Only a single user license, which allows only personal use, is granted when a file is downloaded.
3.2	Downloadable files may not be sold or redistributed under any circumstances without the written discretion of JDCNCSolutions, Inc.

MEMBERSHIP

4.1	JDCNCSolutions, Inc. offers membership free of charge. Membership allows for some features of our site to be unlocked. Some of these features include the ability to place an order, a saved shopping cart, writing reviews, discounts and more.
4.2	We offer special discounts to groups and resellers. If you wish to register a group or apply to be a reseller, contact us at sales@jdcncsolutions.com.
4.3	Your right to use this website is nontransferable. This includes any and all features that are unlocked when you register with us.
4.4	Any password or right given to you to obtain information and/or documents is nontransferable and may only be used by you.
4.5	Any account believed to be in violation of the clauses 4.3 or 4.4, above, will be suspended without any prior notice needed.

ORDERING

5.1

JDCNCSolutions, Inc. is currently only accepting online orders. No phone or faxed orders will be honored at this time.

5.2

To place an order on our website, you must first become a registered member. Please see Section 4 Membership, above, for details pertaining to memberships.

5.3

You can place an order with us via our online checkout process. As part of the checkout process, you will be given the opportunity to check that your order is correct and without errors. If you find any faults in your order after it has been placed, please contact us as soon as possible at sales@jdcncsolutions.com.

5.4

After an order has been placed, you will receive an automated email acknowledging that we have received your order along with a detailed list of the items purchased. Note that the confirmation email may be interpreted as junk email spam. If you do not receive the email, first check your junk email box. If you still cannot find the confirmation email, you can check the order status in the ‘My Account’ section of our website or send us an email at sales@jdcncsolutions.com and we would be happy to send to you a copy of your purchase receipt.

5.5

Once payment has cleared for your order, you will receive an email confirmation. The order’s status will also be changed to ‘Processing’. Note that if you use an instant online payment option, the order status will automatically be changed to ‘Processing’ and you may not receive an email confirmation of payment from JDCNCSolutions, Inc. Please see Section 8 Payment, below, for details on our current payment options.

5.6

Downloadable products:

5.6.1	Downloadable products will be available for download only after payment has cleared and the order’s status is no longer ‘Pending’.
5.6.2	If you use an instant online payment option, your download will be available as soon as you are finished the checkout process. Please see Section 8 Payment, below, for details on our current payment options.
5.6.3	You access downloadable products in the ‘My Order History’ section of your ‘My Account’ area. Click the ‘View’ icon for the correct order number and then click the ‘Download’ icon to download the product.
5.6.4	You have only five (5) downloads per product and those downloads must be completed within seven (7) days of cleared payment. If you do not download the product within this seven day period, the download is considered forfeited, without any guarantee for compensation of loss.
5.6.5	If you are experiencing problems downloading any product please contact us at webmaster@jdcncsolutions.com as soon as possible.

SALES TAX

6.1

We are required by law to charge sales tax on all orders shipping within the state of Pennsylvania. The current tax rate for Pennsylvania is 6.00%.

6.2

Tax Exemption:

6.2.1	No sales tax will be charged if we have a current tax exemption certificate on file for you or your company.
6.2.2	A copy of your tax exempt certificate can be sent via email to sales@jdcncsolutions.com or mailed to JDCNCSolutions, Inc. 2902 Jolly Road Plymouth Meeting, PA 19462.
6.2.3	Any orders placed before we receive the proper tax exemption certificates will be charged applicable sales tax, which cannot be refunded or credited.

PRICING

7.1	All prices are subject to change without any prior notice.
7.2	Any orders that were placed before price changes will not be affected, even if they have not shipped yet.
7.3	All orders are subject to applicable packaging, shipping, insurance and other relevant charges. Any additional charges will be shown in the shopping cart, before the checkout process.
7.4	JDCNCSolutions, Inc. will not honor prices from server errors or from cached pages. If a server error has occurred, any customers affected will be contacted as soon as possible and will be allowed to cancel or edit the affected order. Any resulting refunds will be handled as described in Section 11 Refunds, below.

PAYMENT

8.1

We currently are only accepting PayPal for all orders until future notice.

8.2

PayPal payments:

8.2.1	All payments via PayPal are handled on PayPal’s secure website.
8.2.2	PayPal payments are considered an instant online payment option.
8.2.3	PayPal payments are available to both current PayPal customers as well as non customers. It is not necessary to create an account with PayPal to use our payment solution on their website.
8.2.4	We accept any payment that PayPal accepts. Please see PayPal’s website for the payment options that they currently accept.
8.2.5	If you use PayPal for your purchase with us, please read and agree to PayPal’s ‘Terms and Conditions’ and ‘Privacy Policy’ before using this service. Since PayPal is a third party company, our ‘Terms & Conditions’ and ‘Privacy Policy’ are not valid on their website. Links to PayPal’s legal documents are available in Section 18 Third Party Services, below.

SHIPPING

9.1

We will generally ship out all orders within 24 hours of cleared payment; however, since we cannot guarantee this for every order, it may take us up to 48 hours after cleared payment to ship any in stock items. This time involves processing, packaging and awaiting pickup from the shipping carrier.

9.2

Any items that are made or customized specifically for you are not included in our 48 hour shipping guarantee due to the nature of these items. For such items, please refer to the product’s description page for an estimated time of shipment. This estimate is given as a reference only and has no guarantee associated with it.

9.3

Shipping costs:

9.3.1	All of our shipping costs are determined via our online system. We offer some flat rate charges and other charges are calculated based on the weight of the item(s) and the destination.
9.3.2	On rare occurrences, major errors in these estimates can occur. If this happens, we will contact you as soon as possible to discuss refund, additional charges or changing the shipping method.
9.3.3	The calculated shipping system that we use adds an additional 3 lbs. (1.36 kg) to the total weight of the order. This is to account for the weight of packaging and packing material.

9.4

We currently offer shipping services from the following companies:

        USPS, http://www.usps.com/
        FedEx, http://www.fedex.com/

9.5

The above shipping companies have limited access to your information and are contracted to solely transport your order to you. For more information about the information disclosed to shipping companies, please see our ‘Privacy Policy’.

10.

CANCELLATION, RETURNS AND EXCHANGES

10.1

If you wish to cancel your order, you must send us an email at sales@jdcncsolutions.com before the order has shipped. To find out if your order has shipped, check your email for an order update message that contains shipment notification or check in the ‘My Account’ section of our site for the status of the order. If the order is marked “Delivered”, it has been shipped. If the order has already been shipped, you can return the order to us; see Section 10.4 Returns, below, for details.

10.2

Digital and downloadable products are ineligible for returns or exchanges under any and all circumstances. The only exception is if a digital product is damaged during shipment, such as a CD being scratched or cracked. The damaged item will be replaced with an identical copy only. All sales on these products are final.

10.3

Return Merchandise Authorization (RMA):

10.3.1	In order to return or exchange eligible product(s), you must first contact us via email at sales@jdcncsolutions.com for a Return Merchandise Authorization, or RMA, number.
10.3.2	This number must appear on at least three sides of the box containing the product(s) to be returned or exchanged. Ensure that you write the numbers legibly and at least 1 inch in height such that they are easily readable.
10.3.3	JDCNCSolutions takes no responsibility for items returned to us without first contacting us for an RMA number or without the RMA number written on the shipping box. Although we will try to locate and contact the purchaser of the products, we cannot make any guarantees.

10.4

Returns:

10.4.1	Any products must be returned in accordance to Section 10.3 RMA, above.
10.4.2	Products must be returned within thirty (30) days from the original purchase date.
10.4.3	In order for a product to be returnable for a full refund, less shipping and handling charges, it must be in unopened and/or in unused condition. We determine the condition of the products upon receipt. We will contact you once we have received the item as to its condition.
10.4.4	We do not accept returns on any used or any customized products.
10.4.5	If we determine that a returned item is in used condition, we will contact you indicating that the item appears to be used. You can have the item returned back to you, resulting in applicable return shipping and handling charges.
10.4.6	Any return shipping costs and/or resulting charges will NOT be covered by JDCNCSolutions, Inc. and are the sole responsibility of the customer.
10.4.7	Any refunds are handled as described in Section 11 Refunds, below.

10.5

Exchanges:

10.5.1	Any products must be returned in accordance to Section 10.3 RMA, above.
10.5.2	Any defective product can be exchanged for an equal product within thirty (30) days of the purchase date unless otherwise indicated on the product’s page.
10.5.3	The cost to return the defective product to us must be paid for the by you, the customer. The exchanged product will be shipped to you free of charge using a standard shipping method, usually UPS ground. If you wish to upgrade the return shipping method, please contact us at sales@jdcncsolutions.com before we ship the replacement item. Note that you will be charged the full shipping charge if you choose to upgrade the shipping method.

11.

REFUNDS

11.1	Refunds are only granted if an order has been canceled, a product has been returned or if a server error has occurred.
11.2	All refunds are given without interest.
11.3	We will normally only refund to the source from which payment was received. This greatly diminishes the possibility of fraud. Please contact us at sales@jdcncsolutions.com if you need to have the refund credited to a different account than the purchasing account. Note that this will take longer as we will investigate where the funds are going to protect you, the customer, and JDCNCSolutions, Inc. against fraud.

12.

LIMITED WARRANTY

12.1	The only warranties we offer are those listed on each product’s description page. No other warranties are expressed or implied.

13.

SERVICE ACCESS

13.1	While we try to ensure that our website is normally available 24 hours a day, we will not be held liable if, for any reason, our website is unavailable at any time or for any period of time.
13.2	Access to this website may be suspended temporarily, with or without notice, in the case of critical system failure, maintenance, repair or other reasons beyond our control.

14.

VISITOR MATERIAL AND CONDUCT

14.1	You are prohibited from posting or transmitting to or from this website any material that others would deem threatening or discriminatory.
14.2	You are prohibited from distributing any information or purchased downloadable and/or digital products, freely or for profit, on any other websites or medium.
14.3	You are prohibited from attempting to post or upload any material that is technically harmful, including but not limited to, computer viruses, Trojan horses, worms or any other malicious software or harmful data.
14.4	If you misuse our website, including but not limited to methods described above, we will fully cooperate with law enforcement authorities and disclose any information to those authorities that will identify and/or locate anyone posting material in breach of clauses 14.1, 14.2 and/or 14.3, above.

LIABLILITY

15.1	IN NO EVENT SHALL JDCNCSOLUTIONS, INC, BE HELD LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE DUE TO THE USE OF OUR PRODUCTS AND/OR ANY INFORMATION FOUND ON THIS WEBSITE. This includes, but is not limited to, damages resulting in loss of profit or revenue, installation costs, damage to property, personal injury, death and legal expenses.
15.2	The customer acknowledges that JDCNCSolutions, Inc. and the manufacturer of any products or information found on this website are not to be held responsible for any claim or damage resulting from use.
15.3	Any statements or advice offered or given to visitors and customers is given without charge. JDCNCSolutions, Inc. assumes no liability for such statements or advice and the use of such.
15.4	The customer must agree to indemnify, defend and hold us and our partners, attorneys, staff and affiliates harmless from any liability, loss, claim and expense, including resultant attorney fees, related to your violation of this agreement and/or use of this website.
